i have a broken rear plastic window in my 1991 MX5. the car is garaged and i normally drive with it zipped down or the hood down. Should this have been a failure in a WOF?

Hmm, bad luck. I've heard of people getting failed over scratched/hazed windows too.
IMO, it's not clear what grounds they had for failing it, but there's no point arguing it with the inspector.

Sorry to hear that too. Always gone for my warrant with the top down, tonneau on, and never an issue. Not even a glance at the lid. A discrete enquiry with the inspectors might be in order for clarification. They are after all, people, not Gods to be feared. . . .
